Cooper Stadium. The specific proposal is to rezone the 47.16 acre property to "Commercial Planned Development District." &nbsp;The property is currently zoned "R rural" which is the classification it received when the property was annexed into the city a few years ago. Obtaining this classification would not by itself permit the developer to operate a motor racing track. However, this classification would&nbsp;authorize&nbsp;the&nbsp;developer to seek a "special permit" from the Board of Zoning Adjustment for operation of an "outdoor amphitheater" which, according to the city officials&nbsp;would include a racing facility. Chris Prezutti, the chief of the city's Department of Building and Zoning Services, repeatedly made the point during the meeting that council action approving the district did not mean that the Board of Zoning Adjustment was in any way required to authorize a special permit. Moreover, the point was made by Prezutti and others that the BZA could place conditions on any such special use permit pursuant to section 3307 of the City Code. Also Council could place conditions on any zoning change. </SPAN><SPAN style="mso-fareast-font-family: 'Times New Roman'"><o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="mso-fareast-font-family: 'Times New Roman'">&nbsp;<o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt; mso-fareast-font-family: 'Times New Roman'">While development of the area is ultimately contemplated to include, an automotive research facility, offices, restaurant, and 100 room hotel, it was clear that the linchpin for all development is the racetrack. Prezutti, on behalf of Building and Zoning Services staff concluded that this rezoning request met applicable criteria by having a favorable and immediate impact on the economy; and that the proposal is consistent with the comprehensive plan for the Southwest District. Gary Wilfong on behalf of the city's Department of Public Service and Transportation concluded that the rezoning was acceptable from a traffic and engineering perspective, pointing out that there would be fewer spectators watching events than was the case when baseball was played at Cooper Stadium.</SPAN><SPAN style="mso-fareast-font-family: 'Times New Roman'"><o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="mso-fareast-font-family: 'Times New Roman'">&nbsp;<o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt; mso-fareast-font-family: 'Times New Roman'">Jim Schimmer, Franklin County Development Director also spoke in favor of the proposal. He recounted the five year history of efforts to find a developer for the stadium area which is beginning to fall into serious disrepair. Schimmer viewed the developer's proposal as basically the only viable one that emerged in this five year period. </SPAN><SPAN style="mso-fareast-font-family: 'Times New Roman'"><o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="mso-fareast-font-family: 'Times New Roman'">&nbsp;<o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt; mso-fareast-font-family: 'Times New Roman'">George McCue, attorney from Crabbe, Brown, and James served as the primary spokesperson for the developer along with noise consultant Chris Menge. It was indicated that the facility will also be used for auto shows, rodeos and that the track will be used for vehicle testing. A 35' wall will surround the property. An additional 25' wall will be placed on the south property line. The facility will cost upwards of $40 million and the walls&nbsp;will comprise about $4 million of this total. It was claimed that 300 new jobs will be created and that this facility will become a regional destination for auto testing and related racing. The Columbus noise ordinance prohibits noise in excess of 65 dba from the hours of 7 AM to 10 PM and 60 dba from 10 PM to 7 AM. Testing was done under what was termed "worst hour conditions  using late model stock cars with the monitors downwind from the cars. It was claimed by the noise consultant that at no time was 65 dba exceeded in testing at distances in excess of 1250 feet. McCue said no events would be run until the office building and wall are built. He presented a petition signed by 2,500 people in the area who favor it. </SPAN><SPAN style="mso-fareast-font-family: 'Times New Roman'"><o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="mso-fareast-font-family: 'Times New Roman'">&nbsp;<o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt; mso-fareast-font-family: 'Times New Roman'">McCue detailed the "good neighbor agreements" that had been executed with Franklinton and the Southwest Commission and announced at the meeting that the restrictions in those agreements would be made conditions of all rezoning and any special permit... As you may recall, among the conditions are that the developer will monitor all noise levels and will share those results. Furthermore, the developer would modify course conditions if necessary to comply with noise ordinances. There were questions asked of the applicant as to how this testing would take place after races start. Measurements would initially be made inside the stadium and outside at various places. A correlation would be established between the levels inside and outside. Thereafter, the applicant would measure inside only and rely on the prior correlations to determine the outside noise levels. McCue was dismissive of the objections of Greenlawn Cemetery and Audubon claiming that birds "adapt", and <SPAN class=GramE>that fireworks</SPAN>, concerts, and even some limited auto racing in the parking lot had already taken place historically at Cooper Stadium without any problems caused to the neighbors. Another statistic that was thrown around was that racing events would occur only "1%" of the time. About 2/3 spoke against; the rest for. Many in the gallery wore shirts indicating that those folks were n favor of the rezoning. I stayed and listened to about 1/2 of the speakers. (<SPAN class=GramE>he</SPAN> mentioned the floodwall, arena district, COSI) This development has bypassed those standards entirely. The quality of life and the core values of German Village are threatened by the unknowns this project presents. Greg's most effective point was that the city is mysteriously letting its guard down for a project that could cause a great deal of harm to German Village and the other surrounding areas. As a fallback to denying the rezoning, Greg urged the council to put stringent conditions in the text of any rezoning that would protect the residents from noise etc., and not to rely exclusively on BZA to set the conditions. </SPAN><SPAN style="mso-fareast-font-family: 'Times New Roman'"><o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="mso-fareast-font-family: 'Times New Roman'">&nbsp;<o:p></o:p></SPAN></P> <P class=MsoNormal><SPAN style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt; mso-fareast-font-family: 'Times New Roman'">Mary Rinehart (nearby nursing home employee):&nbsp;&nbsp;The noise will make the nursing home less attractive. I made the point that once the track opened, it would be extremely difficult to do anything about noise violations as was the case at Polaris, and that even noise levels under&nbsp;permitted ordinance levels would be grating given the nature of the sounds of auto racing.
